By using QuickTenders, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the platform.

1. Acceptance of Terms
By registering for or using QuickTenders, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using QuickTenders on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.
2. Description of Services
QuickTenders is a SaaS platform for South African businesses to discover government tender opportunities, track compliance readiness, prepare and submit tender applications, and access related business support services. Features include:
- Tender discovery and matching across national, provincial, and municipal sources
- Compliance document tracking and expiry alerts (CSD, tax clearance, B-BBEE, CIDB)
- AI-assisted tender application writing and review
- Tender Workspace for structured bid preparation and submission
- Secretariat Services for company registration, CIDB grading, B-BBEE certification, and related compliance work handled by our team
- Tender Funding support including SEFA, NEF, and IDC application assistance
- Subcontractor and partner marketplace
- Business plan and financial projection tools
3. Account Registration
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorised access to your account
- You must be at least 18 years old to use the platform
- One account per business entity; account sharing is prohibited
- Organisation accounts created during signup are associated with the email address used at registration
4. Acceptable Use
You may use QuickTenders to:
- Discover and apply for South African government tenders relevant to your business
- Track and manage your compliance documents and readiness score
- Prepare tender applications using the Workspace, AI tools, and document templates
- Order Secretariat Services on behalf of your registered business
- Explore funding support options and build business plans for funding applications
- Connect with subcontractors and JV partners through the marketplace
5. Prohibited Conduct
You may not use QuickTenders to:
- Submit false, misleading, or fraudulent information in tender applications or your business profile
- Misrepresent your CIDB grade, B-BBEE level, CSD status, or any other compliance credential
- Impersonate other individuals, businesses, or government entities
- Upload or distribute malware, viruses, or harmful code
- Attempt to reverse-engineer, scrape, or extract platform data at scale
- Use AI-generated content as the sole basis of a tender submission without review and approval
- Circumvent billing by creating multiple free trial or free-tier accounts
- Use the platform for activities that violate applicable South African law, including but not limited to the Public Finance Management Act, Municipal Finance Management Act, or Preferential Procurement Regulations
- Share account access with other businesses or individuals
We reserve the right to suspend or terminate accounts found to be in violation of these prohibitions without notice.
6. Subscription and Billing
- QuickTenders offers subscription plans (Notification, Starter, Standard, Pro) with a free tier for new accounts
- Subscriptions automatically renew unless cancelled before the renewal date
- Billing is processed by iKhokha — we do not store payment card details
- Refunds are governed by our Refund Policy, available at getquicktenders.com/refund-policy
- Downgrading or cancelling a plan takes effect at the end of the current billing period
- We reserve the right to change pricing with reasonable notice — all prices are displayed in South African Rand (ZAR)
- Free-tier accounts have access to tender browsing and limited platform features; tender applications and AI tools require a paid plan or a pay-as-you-go purchase
7. Pay-As-You-Go and Secretariat Services
- Pay-as-you-go tender applications are charged per tender at the rate displayed at time of purchase
- Secretariat Services (company registration, CIDB, B-BBEE, tax clearance, etc.) are one-time service orders charged at the rates listed in the platform
- Secretariat Service fees are non-refundable once our team has commenced work on your order, unless the service cannot be completed due to circumstances within our control
- Secretariat Services are delivered by our team and are subject to government processing times outside our control — we do not guarantee specific timelines for regulatory approvals
- Tender Funding document generation is included for qualifying paid-tier users; non-qualifying users may be referred to a partner consultant
8. AI Features Disclaimer
QuickTenders includes AI-assisted features powered by Claude (Anthropic) and Gemini (Google). Important limitations:
- AI-generated content is provided as a draft for human review — you are responsible for reviewing, editing, and approving all content before submitting any tender application
- We do not guarantee the accuracy, completeness, legal compliance, or suitability of AI-generated content for any specific tender
- AI features are advisory tools — they do not submit tender applications autonomously or without your explicit instruction
- You retain full responsibility for the content and accuracy of tender submissions made from your account
- AI outputs may contain errors, omissions, or content that does not meet a specific tender's requirements — always verify all content before submission
- Go/No-Go analysis and compliance checks provided by AI are indicative only and do not constitute professional procurement advice

9. Content Ownership
- You retain ownership of all content you create, upload, and submit through QuickTenders, including tender documents, company profiles, CVs, and project references
- By using the platform, you grant us a limited licence to store, process, and transmit your content as necessary to deliver the service
- We do not claim any intellectual property rights over your content
- AI-generated content drafts are provided for your use and become your property upon generation
- You are responsible for ensuring your content does not infringe third-party intellectual property rights
- Tender documents generated using platform templates remain your property and are designed to be submitted without QuickTenders branding
10. Third-Party Integrations
QuickTenders integrates with third-party services including iKhokha (payments), Resend (email delivery), Anthropic (AI), Google Gemini (AI), and Cloudflare (infrastructure). These integrations are subject to those providers' terms. We are not responsible for third-party service interruptions, changes to third-party APIs, or decisions made by government procurement portals. Tender data is sourced from publicly available government procurement feeds — we do not guarantee the completeness, accuracy, or currency of tender listings sourced from external systems.
11. Liability Limitations
To the maximum extent permitted by applicable South African law:
- QuickTenders is provided "as is" without warranty of any kind
- We do not guarantee uninterrupted, error-free service or that all available tenders will be listed on the platform
- We are not liable for indirect, incidental, or consequential damages arising from your use of the platform
- Our total liability to you for any claim shall not exceed the amount paid by you in the 12 months preceding the claim
- We are not liable for tender application outcomes, including disqualification, non-award, or evaluation decisions made by procuring entities
- We are not liable for the accuracy of tender listings sourced from government procurement feeds
- We are not liable for Secretariat Service outcomes dependent on government processing times or regulatory decisions
- We are not liable for AI-generated content you review, approve, and submit
Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold harmless Thuthu (Pty) Ltd t/a QuickTenders, its directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your violation of these terms, or content you submit through the platform.
13. Termination
- You may cancel your account at any time from Settings in the platform
- Upon account deletion, your data will be removed within 30 days (see Privacy Policy)
- We reserve the right to suspend or terminate your account for violation of these terms, with or without notice depending on severity
- After termination, provisions that by their nature should survive will continue to apply including content ownership, liability limitations, and governing law
14. Governing Law and Disputes
These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising from these terms will be subject to the exclusive jurisdiction of South African courts. Before initiating any legal proceedings, you agree to first notify us in writing at legal@getquicktenders.com and allow 30 days to attempt resolution.
15. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or in-platform notice at least 14 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance. If you do not agree to updated terms, you may cancel your account before the effective date.
